These terms govern your use of the Ember Labs website at emberlabs.au and our related services, including the free Business Brain Scan and the Ember Engine subscription. By using this site or submitting the Scan form, you agree to these terms.
Ember Labs is a trading name of Ember Group Australia.
These terms are governed by the laws of South Australia, Australia.
The Business Brain Scan is provided free of charge. It analyses your public website, your publicly accessible content and reviews, and the public presence of competitors you share a market with. It does not access any private data, internal systems, or confidential information. The report it produces is a diagnostic based on publicly available signals — not a legal, financial, or regulated professional opinion.
By submitting the Scan form, you agree to receive your Business Brain Scan by email and to receive follow-up communications from Ember Labs. You may unsubscribe at any time.
Ember subscriptions are offered on a month-to-month or annual basis. Specific terms, including pricing, deliverables, and cancellation conditions, are set out in the agreement provided at the time of sign-up. In the event of any conflict between those agreement terms and these general terms, the agreement terms take precedence.
The Business Brain we build with you is yours. On cancellation, we will export it to you in a readable format. The sub-account infrastructure runs on our agency platform and cannot be transferred independently.

All content on this site — including copy, design, and code — is owned by Ember Labs unless otherwise stated. You may not reproduce or republish it without written permission.
Content Ember produces for your business as part of a subscription engagement belongs to you from the point of delivery and approval. We do not retain rights to content that has been produced for and approved by you.
The Business Brain Scan and other diagnostic outputs are provided in good faith based on publicly available data. We do not guarantee the accuracy of inferred figures (revenue estimates, LTV ranges, or cost-of-gap calculations). These are informed estimates, not audited facts.
To the extent permitted by Australian law, Ember Labs's liability to you in connection with any use of this site or our services is limited to the amount you have paid us in the preceding 12 months, or $500, whichever is greater.
Nothing in these terms limits liability that cannot be excluded under Australian Consumer Law, including guarantees relating to the supply of services.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services re-supplied if they fail to be of acceptable quality and the failure does not amount to a major failure.
We may update these terms as the business develops. Material changes will be noted here with a revised date. Continued use of the site after changes are posted constitutes acceptance of the updated terms.
